RESERVATION, CANCELLATION, AND INDEMNIFICATION TERMS OF JD ARENAL TOURS

I, [Customer Name], (hereinafter referred to as “Customer,” “You,” or “Your”), hereby authorize José David León Pinell, ID 2-0605-0804, on behalf of JD Arenal Tours, (hereinafter referred to as “JD Arenal Tours,” “We,” or “Our”), to charge my credit card in accordance with the terms and conditions set forth below. I understand that any charge will appear on my statement as “José David León Pinell.”

RESERVATION AND MODIFICATION TERMS

Confirmations: All services reserved by the Customer are prepaid by JD Arenal Tours, and confirmations are issued to the Customer electronically for convenience. No reservation will be considered confirmed until we verify availability and payment is made. We will issue reservation confirmations via email or other digital means.

Modifications: JD Arenal Tours is willing to make any service modifications up to 24 hours before the start of the service. The only fees, penalties, and time restrictions that JD Arenal Tours will impose on the Customer are those imposed by applicable service providers and are not under our control. Last-minute modification requests (24-48 hours before the start of the service) should be directed to our operations office at 506-8341-4350 or info@jdarenaltours.com. Any service or modification request will not be considered confirmed or guaranteed until the Customer makes new payment arrangements if there is a price increase, and JD Arenal Tours provides the Customer with updated confirmations.

The Customer has read and verified the details, dates, and times of the services, and by proceeding with the payment, agrees that everything is correct. Payments can be made through various methods such as cards, bank transfers, or other means.

CANCELLATION, POSTPONEMENT, AND REFUND TERMS

All cancellation requests must be received in writing and may be subject to penalties. The cancellation deadline without penalty for each service in your itinerary is stated in the itinerary details under “Cancellations,” or on the payment page before confirming your payment. If you need this link, we can provide it upon request.

If you book and pay before the penalty-free date, you will have the option to make a non-refundable deposit in a single payment to confirm your accommodation and other requested services. The deposit is usually 20% of the total trip cost; the exact amount will be indicated in the itinerary or through the booking medium or payment area.

In most cases, except for flights which are always non-refundable, the penalty-free cancellation date is 45 days before each service. Always check the cancellation details in your itinerary for exact dates, as they may vary.

We offer an alternative to cancellation and loss of deposit before the penalty-free date. This option is to postpone the trip to a later date, allowing you to apply all payments made to another trip within the next 12 months. After the penalty-free date, the terms and potential penalties of the postponement service are handled on a case-by-case basis, as not all providers offer this option in all cases. Some terms and exclusions apply, and eligibility for this service may vary.

Refunds are subject to a 6% administrative and processing fee. Refunds made via bank transfer will be subject to a $150 administrative fee.

No refunds are offered for no-shows or unused portions of accommodation, other services, or packages. Refunds are not provided for flight delays, strikes, political disturbances, acts of God, or force majeure, including hurricanes, earthquakes, fires, floods, and others.

Travel insurance is highly recommended; contact us to learn about our recommended insurance provider. A “cancel for any reason” plan provides the greatest flexibility to mitigate any eventualities that may arise.

ASSUMPTION OF RISKS; TERMS OF DISCLAIMER AND INDEMNIFICATION.

JD Arenal Tours, together with its affiliates, partners, owners, directors, officers, agents, and employees (collectively referred to as the “Indemnified Parties of JD Arenal Tours”), acts solely as an agent selling travel-related services and facilitating the booking of such services. While we strive to work only with the best service providers, the Indemnified Parties of JD Arenal Tours are not responsible for any acts or omissions committed by any service provider, which may result in, but are not limited to, damages, losses, or injuries to customers or other travelers who pay for or travel with the customer. You acknowledge and agree that the Indemnified Parties of JD Arenal Tours have exercised reasonable diligence to connect with third-party service providers that align with your expressly stated preferences. However, the final decision to select specific requested services and contract with third-party service providers rests solely with you, the customer. This decision is based on your own research into available options, and not solely on the advice or recommendation of the Indemnified Parties of JD Arenal Tours. Furthermore, the activities involved in the requested services may entail hazardous activities, unknown locations, and other risks associated with traveling abroad. Please note that you are solely and exclusively responsible for your own well-being, belongings, and possessions. You participate in each of the requested services and related activities at your own risk, and you expressly accept that risk. The Indemnified Parties of JD Arenal Tours cannot and will not be responsible for damages, losses, or injuries arising from your travels or services provided by third-party service providers or events beyond their control.

By proceeding with payment, the customer voluntarily assumes, with full awareness and voluntarily, all risks and full responsibility for anything that may occur during the trip, whether known or unknown. Additionally, you commit to defend, indemnify, and hold the Indemnified Parties of JD Arenal Tours harmless from any damage, loss, or injury that may occur to you and all other travelers subject to the requested services.

Customer’s payment indicates consent to the foregoing terms and conditions on behalf of all other travelers that may apply to the requested services.

APPLICABLE LAW; JURISDICTION; VENUE; ATTORNEY FEES.

These Terms shall be governed in all respects by the laws of the Republic of Costa Rica, applicable to agreements made and to be fully executed within the territory of Costa Rica, without regard to its provisions on conflicts of laws. These Terms are prepared and executed solely in Spanish, and any translation of these Terms into any other language shall have no effect. All proceedings related to these Terms shall be conducted in Spanish. In the event of any dispute or arbitration between the parties arising from these Terms, the prevailing party shall be entitled to all reasonable attorney’s fees, court costs, arbitration fees, and expenses incurred in such litigation or arbitration, including all expenses incurred on appeal. All disputes arising under these Terms or any arbitration shall be filed before the competent courts of justice of Costa Rica, and the parties accept the exclusive jurisdiction of such courts. These Terms apply and govern any change, amendment, addition, or extension of your trip and/or the Requested Services.

CUSTOMER DECLARATION I have read the above agreement and its terms and conditions, and I accept them in full.

I agree to pay the total amount for the Requested Services. I agree to pay in accordance with the Cancellation Terms set forth above. I understand that, in case of service cancellation or modifications, I am responsible for all applicable fees and penalties charged by individual service providers.
